"This is in accordance with the Circular of the Minister of Communication and Information Technology Number 3 of 2022 concerning the Effective Date of Registration for the Implementation of Private Electronic Systems on June 14, 2022 (SE Menkominfo 3/2022)," said Ministry of Communications and Informatics Spokesperson Dedy Permadi, in a virtual conference, Wednesday ( 22/6/2022).
According to him, the determination of the time limit is also in accordance with the mandate of Article 6 of Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions (PP 71/2019).
In addition, this is in accordance with Article 47 of the Regulation of the Minister of Communication and Information Technology Number 5 of 2020 concerning Private Scope Electronic System Operators which has been amended through the Regulation of the Minister of Communication and Information Technology Number 10 of 2021 (PM Kominfo 5/2020).
" The PM Kominfo requires private sector PSEs, both domestic and foreign, to register no later than six months since the PSE registration system is effective at OSS RBA operating, namely January 21, 2022," he added.
Dedy also reminded that the Ministry of Communication and Informatics would terminate health insurance for domestic and foreign private sector PSEs who did not register until July 20, 2022.
The termination of access will be carried out by the Ministry of Communication and Informatics after receiving a request from the ministry/institution authorized to supervise foreign private and domestic PSEs according to their field of business, as regulated by laws and regulations.
6 Category PSE
Meanwhile, PM Kominfo 5/2020 has regulated six categories of private sector PSEs that are required to register, namely PSEs that have portals, sites, or applications online via the internet that are used to provide, manage, and or operate the supply and trade of goods.
Furthermore, it is PSE that provides, manages, and, or operates financial transaction services. PSE that sends material, or paid digital content through a data network, either by downloading it through a portal or website, sending it by electronic mail, or through other applications to the user's electronic system.
PSE that provides, manages, and, or operates communication services including but not limited to short messages, voice calls, video calls, electronic mail, and online conversations in the form of digital platforms, network services, and social media.
Then, PSE is a search engine service, a service for providing electronic information in the form of writing, sound, images, animation, music, videos, films, and games, or a combination of some and, or all of them.
Likewise, PSE, which provides personal data processing services for operational activities, serves the public related to electronic transaction activities.
4.540 PSE
Dedy also said that from 2015 to 22 June 2022, 4,540 PSEs consisting of 4,472 domestic PSEs and 68 foreign private PSEs had registered with the Ministry of Communication and Information.
"Of this number, there are 2,569 domestic PSEs that already have PSE registration marks before the promulgation of PM 5/2020," he said.
In accordance with the provisions of the Minister of Communication and Informatics Decree 3/2022, PSEs that already have an electronic system operator list (TDPSE) before the promulgation of PM 5/2020 must re-register through the OSS RBA before 20 July 2022.
"Other PSEs who have never registered before and meet the criteria for mandatory registration also need to immediately register through the system as mentioned above," added Dedy.
